TERMS OF SERVICE
Please read the following rules and terms of the Modus.me service very carefully before joining. We've tried to keep them as short and simple as possible so they would be easy to understand and follow.1) You must have a valid e-mail address to register to Modus.me. This e-mail address is verified and the system will not let you join without validating at least your e-mail address first. A verification e-mail is sent to you upon registration.
2) New accounts must be activated within 2 days, otherwise these will be deleted.
3) You may refer other people in your household but only ONE member PER computer.
4) You can refer an unlimited amount of people to join the program but you will only get Modus Points and/or Promo Points after your DIRECT REFERRALS.
5) You may only have one account. Do not attempt to create more than one account otherwise all of your accounts will be terminated. You should never need another account. If you have forgotten your log-in information all you need to simply do is request it to be e-mailed to you.
6) All payments are made via PayPal or Alertpay and no other payment method is being used at this time. You can only request for payment from your Promo Points. You must manually request for the payment to be processed and it will be issued within 5 business days.
7) If you want cash out from your Promo Points at the Promo Shop you must have a valid payment e-mail address given to us correctly. If you misspell it we can not assume responsibility for your money.
8) We do not accept any frame baker site at website advertisement. We provide you a test if you are not sure whether your site is acceptable.
9) Advertising fees are to be paid via PayPal or Alertpay only. Note that not every card type is accepted at these payment systems.
10) In case of viewing a Website Advertisement you will get 1 Modus Point per every 5 seconds viewed. In case of watching a Video Ad you will get 2 Modus Points per every 5 seconds watched. Modus Points will immediately appear on your internal account. Note that in case of questioned ads you only get Modus Points if you answer correctly.
11) Any applicable fees and other charges are payable in advance and are not refundable in whole or in part.
12) Sending unsolicited mail to people, asking them to join Modus.me without any prior contact with you is not only against our policy, but it is also illegal. Only users registered at Modus.me are allowed to send invitation mail through our system, but one user can only send one message to the same e-mail address. We have ZERO tolerance against spamming and if we receive just ONE SINGLE complaint against you for spamming, we first verify that the spam incident did occur and then we terminate your account.
13) By joining Modus.me, you agree that you shall be fully responsible for any filing of taxes that is required by your governmental authorities. Because of our worldwide, international status - we will not do this for you.
14) You are not an employee of Modus.me and you are not an independent contractor for Modus.me. We create an anthropocentric connection from the advertiser to the consumer within our advertising system. You or Modus.me has the right to terminate this relationship at any time.
15) Any exploitation of system bugs (in order to cause damage and/or to make a profit out of it) or cheating results in immediate account termination.
16) Regarding every part of modus.me we do not accept any:
- Aberrant pornography and paedophile content.
- Don't post anything showing bad stuff like animal abuse, drug abuse, or bomb making.
- Violence is not allowed, like someone getting hurt, attacked, or humiliated.
- Don't post gross-out videos of accidents, dead bodies and similar things.
- Respect copyright. Only upload videos that you made or that you are authorized to use. This means don't upload videos you didn't make, or use content in your videos that someone else owns the copyright to, such as music tracks, or videos made by other users, without necessary authorizations.
- We encourage free speech and defend everyone's right to express unpopular points of view. But we don't permit hate speech (speech which attacks or demeans a group based on race or ethnic origin, religion, disability, gender, age, veteran status, and sexual orientation/gender identity).
- There is ZERO tolerance for predatory behaviour, stalking, threats, harassment, invading privacy, or the revealing of other members' personal information.
Anyone caught doing these things may be permanently banned from Modus.me.
17) We are not be liable for delays or failure in performance caused by acts of God, war, terrorism, strike, labour dispute, work stoppage, fire, act of government, or any other cause, whether similar or dissimilar, beyond our reasonable control. We reserve the right to restrict, alter, or modify fees, benefits, rules, regulations, special offers, membership terms and conditions or terminate services any time on one month's notice - notice will be sent to your last notified email account and is effective irrespective of whether the email is successfully delivered as long as it is sent to the correct account.
18) All material you upload to the Website is free of any virus, worm, Trojan horse or similar thing and will not materially adversely affect the normal operation of any software or hardware of ours or of any visitor to our Website. You are advised to ensure that before you upload anything other than text to the Website, you make sure it has been passed through up-to-date virus preventing software.
19) Except where otherwise noted, all the content of the Website (including their design, text, graphics and arrangement) and the software used, are owned and controlled by us or our advertisers and are protected by copyright and other intellectual property right laws. You may only take copies of any written content for your own personal use. All other copying is not allowed.
20) After you have requested for cash out you can not change the amount till it is in pending status.
21) Video advertisement cost pre-calculation can differ from the amount that will be charged. Note at adding video advertisement you must add the length of the video precisely to avoid miscounts. In case of choosing extra video advertisement options (except for ‘question+’ option) extra fees can be charged.
22) Note when using any advertisement option at Modus.me you must keep the rules written in the TOS or required by law belonging to advertising, otherwise your money will be lost, because of suspicion of a fraud.

* Master Resale Rights: Master Resale Rights are highly desirable, with people scrambling all over the internet looking for the newest product to promote. Master Resale Rights not only allow you to resell the product, but also pass on the rights to your customer so that they can sell the product also. In many cases resellers either sell the product as it is, or they also offer the option of reprint rights (Master Resale Rights) and normally charging three times as much as the product costs in itself.
* Private Label Rights: Private Label Rights are king right now, with more and more membership sites and PLR packages popping up all over the place. This is a highly desirable product as you can change the product in any way that you want, change text, change the source code, and even add your name as the author/creator in many cases. In saying this, a lot of people think they are now the owner after obtaining Private Label Rights, please understand that you are not unless stated! Read the license carefully before you alter any part of the product. While there are those who will profit from selling products with Private Label Rights, the smart resellers will create their own product with the source files included, for an eBook the source files are normally in MS Document format. They will create their own eCover, own website, graphics, add their own affiliate links and even add links to more products in their collection.
* Basic Resale Rights: This simply means that once you purchase a product you can use it for yourself and even sell the product, but your customer receives no rights whatsoever. Every digital product has a licence file (txt, pdf). Read it through in order to know your rights in connection of that particular product.
24) We have the right to suspend or terminate your account at any time, for any reason and without warning or notice. If we decide to give a notice, we will notify you by e-mail. If you are caught cheating in any way, your account will be deleted without notice and your e-mail will be kept to be posted on a future "wall of shame".
25) "Modus.me" is our trade mark. All other trademarks, product names and company names or logos cited anywhere on the Website are the property of their respective owners. You may not use any trade mark without the relevant owners' written consent.
26) We have the right to change our terms of service at anytime without prior consent or notice. Latter notices will be posted via the Modus.me stats area or e-mailed to you.
27) Except for private areas you have access to read the Forum.
28) You can post new topics and answer the previously created ones, if you have registered at Modus.me and logged in.
29) In the Forum you must respect other Modus members, otherwise you will be banned.
30) Without offending other members you have the right to express yourself.
31) In the Forum topics and posts it is prohibited to publish any attempts to get referrals, money requests, money exchange, money offers or request of services. It is also prohibited to duplicate topics or posts, publish nonsense or illegal content, spam the forum with messages or posts, share personal data, e-mail addresses, website links, any kind of IDs.
32) Any kind of intimidation, accusation without proof, threat or disrespect against Modus.me or the staff or assistants of Modus.me even here or anywhere else will be seen as disrespectful and may lead to the removal of the privilege of using the Forum as well as the suspension of your account permanently, suspension of membership temporarily or suspension of any other benefits.
33) It is strictly prohibited to post messages or topics that may indirectly or directly be prejudical to Modus.me, its Members, Advertisers, sponsors or service providers will be considered an offense.
34) To use Forum at least 50 advertisements must be viewed or watched by a Member.
35) You are responsible not to misrepresent yourself, your age, your affiliation or any other personal data in any ways at Modus.me, especially at the registration.
36) Registration at Modus.me under the age of 14 is prohibited!
37) At Modus.me adult and gambling category or any kind of adult and gambling content is not available under the age of 21.
38) All gifts presented at Modus.me are not property of Modus.me. Modus.me is only a third party between the providers of products or services and the consumers.
39) You agree that you use Modus.me services, including Modus.me website at your own risk. Modus.me services, website and content are provided ‘as is’. To the fullest extent permitted by law, Modus.me, it’s subsidiaries, parents, affiliates and each of their officers, directors, employees and agents disclaim all warranties, express or implied, in connection with Modus.me services and your use thereof. Modus.me makes no warranties or representations about the accuracy or completeness of Modus.me service’s content or the content of any websites linked to Modus.me services and assumes no liability or responsibility or any errors, mistakes, or inaccuracies of content, personal injury or property damage of any nature whatsoever, resulting from your access to and use of Modus.me services or Modus.me website, any unauthorized access to or use of our secure servers and / or any and all personal information and / or financial information stored therein, any interruption or cessation of transmission to or from Modus.me services, any bugs, viruses, Trojan horses or the like which may be transmitted to or through Modus.me services or Modus.me servers by any third-party and / or any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of any content posted, e-mailed, transmitted or otherwise made available via Modus.me services. Modus.me does not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third-party through Modus.me services or service advertised or offered by a third-party through Modus.me services or any hyperlinked website or featured in any banner or other advertising, and Modus.me will not be a party to or in any way be responsible for monitoring any transaction between you and third-party providers of products or services. As with the purchase of any product or service through any medium or in any environment, you should use your best judgment and exercise caution where appropriate.
Modus.me is not responsible or liable in any manner for any third-party content posted, uploaded or displayed on the site or in connection with Modus.me services, whether caused by users of Modus.me services or by any of the equipment or programming associated with or utilized in Modus.me services.
Modus.me services may be temporarily unavailable from time to time for maintenance or other reasons. Modus.me assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of user communications. Modus.me is not responsible for any problems or technical malfunction of any telephone network or lines, computer systems, servers or providers, computer equipment, software failure of email or players on account of technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to users or to any other person’s computer related to or resulting from participating or downloading materials in connection with Modus.me services. Under no circumstances will Modus.me be responsible for any loss or damage, including any loss or personal injury or death resulting from anyone’s use of Modus.me services, any third-party content posted on or through Modus.me services or transmitted to users of Modus.me services, or any interactions between users of Modus.me services, whether online or offline.
